1. 1. General InformationThis Privacy Policy defines the principles of processing and protection of personal data provided by Users in connection with their use of the services offered through the website https://www.softwareness.org/ (hereinafter referred to as the "Website").

The administrator of personal data contained in the Website is Tenacious sp. z o.o. with its registered office in Gajewo, at ul. Kameralna 22, 11-500 Gajewo, entered into the register of entrepreneurs of the National Court Register, NIP: 8452000451 (hereinafter referred to as the "Administrator").

The Administrator takes special care to protect the interests of the persons to whom the data relates, and in particular ensures that the data collected by it is:

  • processed in accordance with the law,
  • collected for specified, legitimate purposes and not further processed in a way incompatible with these purposes,
  • substantively correct and adequate in relation to the purposes for which they are processed,
  • stored in a form that permits identification of the persons to whom they relate, for no longer than is necessary to achieve the purpose of processing.

Purpose and Scope of Data CollectionPersonal DataPersonal data identifying specific Users (such as name, email address, phone number) is processed by the Administrator only when it has been voluntarily provided by Users (e.g., by filling out a contact form). This data is processed for the purpose of:
  • handling inquiries sent via the contact form,
  • providing services by the Administrator,
  • sending marketing and commercial information (if separate consent has been given),
  • sending newsletters (if consent has been given),
  • conducting marketing activities,
  • managing customer relationships in CRM systems.

The Administrator processes the following personal data of Users that has been voluntarily provided by them:

  • name,
  • email address,
  • phone number,
  • content of messages sent via the contact form.

Operational and Analytical DataRegardless of the provision of personal data, while using the Website, data regarding the User's visit is automatically collected, including:

  • IP address,
  • date and time of visit to the website,
  • information about the web browser and operating system,
  • pages viewed,
  • time spent on the website,
  • transitions between subpages,
  • actions taken on the website.

The above data is collected using cookies and analytical tools (e.g., Google Analytics) and is used for the purposes of:

  • necessity for the performance of a contract or to take steps at the request of the data subject prior to entering into a contract (Article 6(1)(b) GDPR) - in the case of services provided by the Administrator,
  • legitimate interest of the Administrator (Article 6(1)(f) GDPR) - in the case of processing data for the purpose of handling inquiries sent via the contact form, storing data in CRM systems for the purpose of managing customer relationships, as well as pursuing or defending against claims.
  1. 4. Data Retention PeriodPersonal data is stored for the period necessary to achieve the purposes for which it was collected, including:
  • for the time necessary to handle the inquiry or complete the order,
  • in the case of data used for marketing purposes and future contact - until an objection to such processing is raised or consent is withdrawn,
  • for the period required by relevant legal provisions, in particular tax and accounting regulations,
  • for the period necessary to pursue or defend against claims.

Data processed on the basis of consent is stored until the consent is withdrawn.

  1. 5. Data RecipientsPersonal data of Users may be transferred to entities that process personal data on behalf of the Administrator, including:
  • hosting service providers (Webflow Inc.),
  • cookie management tool providers (Cookie-script.com),
  • analytical tool providers (Google Analytics),
  • project management and CRM system providers (ClickUp),
  • IT service providers,
  • technical support service providers.

The Administrator does not transfer Users' personal data to other entities or entities based outside the European Economic Area, with the exception of tools provided by entities from the USA, which ensure an adequate level of data protection, in accordance with the requirements of the GDPR.

  1. 6. Rights of Data SubjectsEach person whose data is processed has the following rights:
  • the right to access their data and receive a copy of it,
  • the right to rectify (correct) their data,
  • the right to erasure of data,
  • the right to restriction of processing,
  • the right to object to the processing of data,
  • the right to data portability,
  • the right to withdraw consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal),
  • the right to lodge a complaint with a supervisory authority (the President of the Personal Data Protection Office).

  1. 7. CookiesThe Website uses cookies, which are computer data, in particular text files, stored in the User's terminal device. Cookies contain the name of the website they come from, the time they are stored on the terminal device, and a unique number.

The Website uses the following types of cookies:

  • cookies necessary for the functioning of the Website - cookies that allow the use of basic functions of the Website, such as secure logging in, ensuring security, or saving the user's session,
  • analytical cookies - cookies that allow the collection of information about how the Website is used, including visit statistics and use of individual elements of the Website, which helps to improve its structure and content.

The Administrator uses analytical tools, such as Google Analytics, Google Search Console and Google Tag Manager, which use cookies. These tools help to understand how Users use the Website.

Most web browsers accept cookies by default. However, the User can change their browser settings so that cookies are blocked - in whole or in part, e.g., only from third parties, or to receive a message each time cookies are sent to the User's device. Detailed information about the possibility and methods of handling cookies is available in the software settings (web browser).

Blocking or limiting the use of cookies may affect some of the functionalities available on the Website.

Cookie management on the Website is done using the Cookie-script.com tool, which allows the User to control cookies.

  1. 8. Security MeasuresThe Administrator applies appropriate technical and organizational measures to ensure the protection of processed personal data. In particular, it protects data against unauthorized disclosure, unauthorized acquisition by an unauthorized person, processing in violation of applicable regulations, and change, loss, damage or destruction.

The security measures applied by the Administrator include:

  • securing the Website with HTTPS protocol (provided by the Webflow platform),
  • using secure, reputable service providers (Webflow, ClickUp),
  • using high-security passwords for systems storing data,
  • limiting access to personal data only to authorized persons,
  • regular reviews of applied safeguards.
  1. 9. Final ProvisionsThe Administrator reserves the right to make changes to this Privacy Policy. The Administrator will inform Users of any significant changes by publishing an updated Privacy Policy on the Website.

This Privacy Policy is effective from May 12, 2025.
